In the rapidly evolving landscape of environmental regulation, the challenge of managing Per- and Polyfluoroalkyl Substances (PFAS) has become a critical focus for companies. With the current regulation of TSCA section 8, this is particularly relevant for companies producing in or importing goods into the United States. With the Toxic Substances Control Act (TSCA) setting stringent standards, the newly released PFAS Rule group by iPoint Compliance emerges as an essential solution for navigating the complexities of PFAS compliance, ensuring that importers and producers can meet the rigorous demands of TSCA section 8.
What lasts a long time...on October 11, 2023, the regulation announced by the Environmental Protection Agency (EPA) on September 28, 2023, was published in the Federal Register (FR). The regulation will take effect on November 13, 2023.
This regulation establishes reporting and record-keeping requirements for per- and polyfluoroalkyl substances (PFAS) under Section 8(a)(7) of the Toxic Substances Control Act (TSCA). Companies that manufacture or have manufactured (or imported) these chemical substances will be required to provide the EPA with information on the use of PFAS, production volumes, byproducts, disposal, exposure, and existing information on environmental or health impacts for the period starting January 1, 2011. The deadline for submitting this data is 12 or 18 months (24 months for small businesses), meaning the data must be reported to the EPA between November 2024 and May 2025 (or by November 2025 for small businesses). The purpose of this regulation is to better characterize the sources and quantities of PFAS produced in the United States.
The enactment of TSCA has ushered in a new era of environmental responsibility, particularly concerning PFAS, a group of chemicals known for their persistence and health risks. For manufacturers and also for importers to the US, understanding and complying with these regulations is paramount. iPoint offers an unparalleled advantage, providing a comprehensive toolset for PFAS detection, analysis, and management tailored to the unique challenges faced by both, manufacturers and importers.
The emerging PFAS regulations, both in US and elsewhere, add a new layer of complexity to achieving material compliance. It is no longer sufficient to deal with individual substances or clearly defined groups of substances, but to be able to control a huge group of substances that are not explicitly specified. On top of this, oftentimes the supply chain needs to be supported in understanding what is actually required.
To help you meet these challenges, iPoint experts have created the new PFAS rule group, comprising thousands of PFAS substances based on reliable sources like IMDS and OECD. The rule group therefore will allow you to check your current information for contained PFAS to identify hotspots and high risk areas for a more targeted communication to your suppliers. In addition it supports you in identifying PFAS belonging to a certain structural group, thus further narrowing down the focus areas and enhancing readiness for future regulatory action – should regulators focus on specific sets of PFAS only.
Developed with the know-how of substance experts, the iPoint Rule group is designed to simplify the complexities of PFAS compliance. Its extensive compilation of relevant substances and predictive analytics enable companies to proactively address PFAS concerns, ensuring compliance with regional and global regulations e.g. TSCA section 8 or the emerging EU regulation and safeguarding against potential disruptions to their operations.
Navigating the complexities of PFAS regulations globally, iPoint offers a solution that is both effective and forward-looking. As regional and global activities continue to shape the regulatory landscape, iPoint stands out as a critical tool for achieving compliance, ensuring that companies can focus on their core business without the burden of regulatory challenges.
iPoint's unveiling of this Rule Group underscores its dedication to pioneering environmental compliance solutions. By tackling the intricate challenges of PFAS regulation head-on, iPoint establishes a new benchmark in the sector, charting a course towards compliance and environmental guardianship.
