On July 16, 2019, the European Chemical Agency (ECHA) has published 4 new candidate substances. This candidate list that contains the so called SVHC – „substances of very high concern“- now contains 201 entries in total.

Obligations regarding SVHC (candidate substances)
For substances on the candidate list, the information obligations according to article 33 apply from the day on they have been put on the list.
Suppliers of articles have to inform their recipients uncalled if one of these substances is contained in any part of the article above the threshold of 0,1%. Consumers will receive this information on request only. The definitions of the article as a reference value have been ruled by a decision of the European Court of Justice in 2015, (See C-106/14) and apply to any single article contained in a complex one.
Important changes in the near future
Already in May 2018, the EU has published an amendment of the Waste-Frame directive that will have an enormous importance on SVHC handling in the future and puts more pressure on SVHCs.
ECHA will have to set up a database until January 2020 were information according to article 33 have to be administered and made available for waste treatment operators and the public.
From beginning of 2021, suppliers of articles must report the information according to article 33 to that database.
